TERMS AND CONDITIONS OF SALE

 

DELIVERY

Unless otherwise agreed, the place of delivery of the goods shall be the seller's premises.  As from time of delivery, the goods are at the risk of the buyer, who shall be responsible for payments of freight and premium for transit insurance.

 

PRICES

All prices in quotations are based upoin ex-factory list prices and present day currency exchange rates.  They may be taken as firm for a period of 30 days for the date of the quotation.  We reserve the right to amend final selling prices in the event of significant changes in ex-factory list prices or exchange rates.

 

GST

All prices stated in quotations and on our website do not include GST.

 

WARRANTY

a) Warranty is limited to the manufacturer's warranty.

b) Goods found to be defective due to manufacturing faults shall be repaired or (at the option of the seller) replaced if returned to the seller within the warranty period.

c) No warranties shall be implied on the part of the seller by reason of the Sale of Goods Act or any other enactment other than the warranty herein recorded.

 

PAYMENT

For customers without an account, terms are strictly cash.  If the buyer has an approved credit account with the seller, payment for goods supplied shall be made by the 20th day of the month following that in which the goods are supplied by the seller, unless otherwise agreed.

 

OWNERSHIP

a) Notwithstanding delivery of the goods, ownership of such goods is retained by the seller until full payment of the purchase price has been made by the buyer.  Receipt by the seller of any cheque, bill of exchange or promissory note shall not be deemed to be payment for the goods until such instrument has been honoured and until honouring has occurred, shall not affect the seller's right to take or resume possession of the goods.

b) If the goods are resold by the buyer before full payment has been made to the seller, the proceeds of sale shall be the property of the seller and the buyer shall be obliged to keep such proceeds separate from its own monies.

c) The buyer hereby irrevocably empowers the seller and its servants and agents to enter upon any premises occupied by the buyer to search for and remove any goods supplied by the seller without in any way being liable to the buyer or any person or company claiming through the buyer.

 

LAW

Any contract entered into by the seller and the buyer shall be governed by the laws of New Zealand.
